Highlights of 08/11/20 update... - President Trump signed executive orders to extend the "extra" unemployment beyond July for $400 per week. The orders also include a "payroll tax holiday" for employee social security tax and medicare tax starting Sept 1st. These tax holiday may need to be repaid later. But Congress also could forgive the amount due. In fact, Trump promised to forgive the amount due if he is still President. PROBLEM... there is partisanship controversy regarding the legality of the above orders which will result in delays. Congress could still come up with their own new legislation which may result in the withdrawal of the executive orders. Highlights of 08/04/20 update... - PA business grant application round 2 is opening... August 10-28th. Highlights of 07/10/20 update... - PA business grant application is asking many clients for legal start up paperwork and license registrations. You need to call them to ask what they will accept if you were not required to register or obtain any type of license. Other clients have used past year tax returns to prove existence. New PUA unemployment question has error!!! There were supposed to be additional options to include decreased work hours due to Covid-19. Small Business Exemption available for the extended FMLA rules.
Small businesses with fewer than 50 employees will be eligible for an exemption from the leave requirements relating to school closings or child care unavailability where the requirements would jeopardize the ability of the business to continue. The exemption will be available on the basis of simple and clear criteria that make it available in circumstances involving jeopardy to the viability of an employer's business as a going concern. Labor will provide emergency guidance and rulemaking to clearly articulate this standard.
Labor will be issuing a temporary non-enforcement policy that provides a period of time for employers to come into compliance with the Act. Under this policy, Labor will not bring an enforcement action against any employer for violations of the Act so long as the employer has acted reasonably and in good faith to comply with the Act. Labor will instead focus on compliance assistance during the 30-day period.
